Constitution Expert Douglas Gibbs: Congress Would Have To Call The National Guard Into Service Under Article 1, Section 8 And The President Would Then Decide ‘Where’ To Put Them

I want to thank my KMET talk show host colleague and Constitution expert Douglas V. Gibbs for his input on this issue.

It wasn’t the answer I wanted to hear–I want the President to be able to declare a national emergency and call out either the Army or the Guard.

I cannot see Trump getting all Republican Senators and congressmen together on this. That would leave him the option to move BP agents from other states to the Texas-Mexico Border (where the Invaders are expected to try to break in) or go against the Constitution by placing Army troops on the Border.

Why the President cannot put troops on the Border to protect the nation from Invasion is something I’ve never understood. Doesn’t the country have a duty and a right to protect itself?
